COVID-19 – Rights and Remedies for Ontario Landlords During the Pandemic

The COVID-19 pandemic has had a significant impact on everyone, however, landlords seem to get the short end of the stick when it comes to public sympathy. Though we all can appreciate the difficulties of tenants who are having trouble paying rent, the reality is that most landlords rely on those regular rent payments to be able to cover their own costs and obligations.

 

Notable Changes for Ontario Landlords Due to COVID-19

Rent Repayment Agreements

Though not technically required by law, Ontario has formally “encouraged” landlords to do what they can to negotiate a repayment agreement with tenants before proceeding with eviction proceedings. Landlords seeking an order from the Landlord and Tenant Board will be expected to show their efforts to try to allow the tenant to get caught up before an order will be granted.

Evictions

Ontario resumed hearing eviction applications as of August 1st, 2020. As mentioned above, the Board will now take the landlord’s willingness to give the tenant a fair chance to repay the unpaid rent before issuing eviction orders. The Landlord and Tenant Board’s in-person counter services are closed, but landlords can apply online here.

Entering a Rental Unit

During the COVID-19 pandemic, landlords are encouraged to avoid entering a rental unit unless absolutely necessary. If entry is unavoidable, landlords should work with the tenant to coordinate the entry and to maintain social distancing protocols as much as possible.
